Summer Immunization Requirements

For Summer Schools Students:

Immunization requirements must be met for summer school students for their new grade within 14 days of July 1. Example: A student attending summer school after their 6th grade year would be required to meet the requirements for 7th grade within 14 days of July 1.

Why is this the requirement?
All students must be vaccinated to attend school in New York State (NYS). Public Health Law §2164 and New York Codes, Rules and Regulations (NYCRR) Title 10, Subpart 66-1 require every student entering or attending any PreK-12 school in NYS to meet these requirements. The immunization requirements must be met within 14 days of the first day of school attendance. (The 14 days may be extended to not more than 30 days when the student is transferring from out of state or from another country.)

Article 1 §2 (15) states, “The term ‘school year’ means the period commencing on the first day of July in each year and ending on the thirtieth day of June the following year.” Therefore, each school year begins on July 1, which is during the typical summer school session.

For Summer Athletics:

For athletes who do not attend summer school and do not attend year-round instruction, the 14 days begin when the students start attending school, on the first day of school, typically in September. Participating in school sports during the summer is not attending school.

Why is this the requirement?
NYSED’S Vaccination Requirements Applicable to All Students explains: For students participating in interscholastic athletics, schools can consider the beginning of the academic year to be the start of the 14-day time period. For students not attending year-round instruction, the 14-day time period commences on the first day of instruction for the school year (July for students attending summer school or September for students not attending summer school) or first enrollment during the school year.
